What do we need to open your escrow?

Missing a piece? Send what you have, and we’ll ask for the rest.

Buying or selling a home

  • The purchase agreement, signed by the buyer and the seller, with any counteroffers and addenda
  • A phone number and an email for each buyer and each seller
  • Each agent’s name, brokerage, phone number and email
  • How to reach the buyer’s loan officer, if there’s a loan
  • For the seller: each lender with a loan on the home, and the homeowners association (HOA), if there is one

A refinance

  • The new lender’s name, and the loan officer’s phone number and email
  • Each owner’s name, spelled the way it appears on the deed
  • Each lender with a loan on the home now

Buying or selling a business

  • The purchase agreement both sides signed, showing the price and what the buyer gets
  • The seller’s business names and addresses from the past three years, old ones included
  • A list of the equipment and inventory in the sale
  • The lease, and the landlord’s name and phone number
  • The liquor license number, when the sale includes one

Why the old business names? In a sale under California’s bulk sale law, the buyer must get that list from the seller (Commercial Code §6104). How a bulk sale works.

  2. Step 2: We set up your file

    Once the signed contract is in, we open the escrow. Next come the escrow instructions: the written steps both sides agree to. Read them closely before you sign.

  3. Step 3: The deposit arrives

Questions about opening an escrow

Who can open an escrow?

Anyone in the deal can call us to start one. For a home sale, one of the agents often sends us the signed contract. For a refinance, the lender usually does. Buyers and sellers can call us too.

Do I need a signed contract before I call?

No. Call with questions at any time, even before there’s a deal. We open the escrow when the signed contract arrives.

Why won’t the form take account numbers?

A web form or an email isn’t a safe place for them. The form won’t send bank account, card or Social Security numbers. If a step needs one, call us at (714) 544-6525.
